Servers Pulse (trading as ServersPulse) operates this Service. By accessing and using ServersPulse ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you should not use the Service.

Description of Service

ServersPulse provides Minecraft server monitoring services, including:

• Real-time server metrics tracking (TPS, MSPT, memory, players)
• Alert notifications via Discord
• Server incident history
• Weekly performance reports
• API access for server data ingestion

User Accounts

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Providing accurate and complete registration information
• Notifying us immediately of any unauthorized use

You must be at least 13 years old to use this Service.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose
• Spam, distribute malware, or engage in any harmful activity
• Exceed your plan's server limit or abuse rate limits

Intellectual Property

The Service, including all content, features, and functionality, is owned by ServersPulse and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Service (e.g., server names, alert configurations), but grant us a license to use such content solely for providing the Service.

Service Rules

API Usage

• You may only use API keys assigned to your account
• Do not share your API keys with others
• Do not attempt to access servers you do not own
• Rate limits apply per your subscription plan

Server Monitoring

• You may only monitor servers you own or have permission to monitor
• Do not use the Service to monitor servers without authorization
• We reserve the right to suspend servers that violate our policies

Discord Integration

• Use of the Discord bot is subject to Discord's Terms of Service
• You must have permission to add bots to Discord servers
• Alert messages must comply with Discord community guidelines

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We make no warranty regarding the accuracy, reliability, or completeness of any metrics or data.

Limitation of Liability

IN NO EVENT SHALL SERVERSPULSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless ServersPulse and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content submitted to the Service

Refund Policy

All payments are processed by Paddle.com Market Limited ("Paddle"), our Merchant of Record. Paddle handles all billing, payment collection, and refund processing on our behalf.

If you are not satisfied with your purchase, you may request a full refund within 14 days of your payment by contacting us at [email protected]. Refunds are processed by Paddle and typically appear on your statement within 5–10 business days.

Termination

We may terminate, suspend, or restrict your access to the Service at any time, with or without cause, with or without notice, including but not limited to:

• Violation of these Terms of Service
• Abuse or misuse of the Service
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Creating risk or legal liability for us
• Disruption or degradation of the Service for other users

We reserve the right to remove or disable access to any servers, content, or accounts that violate these terms at our sole discretion.

You may cancel your subscription at any time through your account settings or by contacting us.

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data according to our data retention policy
• Any outstanding fees remain payable

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ServersPulse operates, without regard to its conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "last updated" date.

Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and ServersPulse regarding your use of the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
